Non-Exempt Rules

This course will provide an overview on what non-exempt means under the FLSA, what you are required to provide, and how to ensure hours are appropriately tracked. We’ll also go over typical pitfalls we see with regard to non-exempt employees.

Exempt Rules

This course will give an overview of exempt employees, what you do for salary basis, what the salary thresholds are, and appropriate treatment of wages. We’ll provide some hypotheticals as well to ensure understanding.

Classifications of Exempt v. Non-Exempt

This will provide an in-depth overview of the duties test and the appropriate classifications. We’ll provide the definitions under the law, specific examples that the DOL has provided would qualify, and how to appropriately write analyze a job description.

Hours Worked

This is a crucial definition to understand under the FLSA. We’ll go over on-call hours, travel time, commute time, and other important issues that determine whether or not an employee should be paid.

Time Keeping and Meal Breaks

One of the biggest issues that state Attorney General offices love to pounce on is meal breaks. We’ll discuss how to ensure your company is compliant, best practices, and how to ensure employees understand their obligations as well.

Independent Contractors

Another test that is often looked over is the independent contractor test. The federal law has one and most states have their own specific test. We’ll provide an overview of the basic tests you should be aware of and how to appropriately spot issues.

Deductions from Wages

When can you deduct and when can you not deduct? What do you do for salaried employees? We’ll provide an overview of federal and state specific laws on what you are permitted to do when it comes to employee’s pay.
