The Pregnant Workers Fairness Act (PWFA) went into effect June 27, 2023. The agency charged with enforcing the Act, the EEOC, has issued its rule on how to comply. The EEOC’s final rule to implement the Pregnant Workers Fairness Act (PWFA) is today, June 18, 2024. The EEOC’s summary of the rule is here.
What does this mean for your workplace? It means the EEOC has let everyone know what it expects employers to do and will consider that when enforcing the Act now. Cases challenging the “elective abortion” aspect of the law are everywhere and the decisions are already split in the lower courts. Do not be fooled by that unresolved issue in the states with abortion restrictions: you have a legal obligation to follow this law.
